- The link you gave is to a painting. This is a mosaic. The act of publicly displaying the mosaic without a notice put the mosaic into the public domain. I am not sure about the display history of the painting and the accuracy of the Whitney copyright statement, but it does not seem relevant to the mosaic in any case.
